Confused About Copyright?


So you decided you'd like your digital negatives from the professional photographer that you hired, but you're a bit confused about copyright. Many photographers will tell you that they'll give you the copyright as part of the sale. But is that what you really need? Indeed, many PHOTOGRAPHERS aren't clear about how this works. You probably want the digital negatives so you can make your own prints. But are you going to use them for advertising? Do you want to publish the images in a magazine? Probably not! Here's what copyright means:
*You create it, you own it
*It gives the image maker the legal right to capitalize on your work

So what is it that you really need? You simply need a license agreement to reproduce your digital images for your personal use. If a photographer is offering to give you his copyright, it means he/she can't actually use the images anymore for his own promotional needs. You should be wary if your photographer is making you such an offer. It likely means that even if he/she takes really nice images, they may not be as educated as you might think. Make sure they are very clear about what permissions you really get with your digital negatives.

They best way to know exactly what you're getting in your wedding photography package is to have it all clearly stated in a contract. If your photographer is just taking your money and not offering you a contract, you may be dealing with a photographer that is just after your money! I've heard nightmare stories about photographers disappearing with images that the bride and groom paid good money for. Don't let this happen to you. A contract should state your image usage rights and everything else you have discussed with the photographer that you expect to receive from the day.

Finally, and on another note, make sure your photographer is insured! An uninsured photographer is probably an amateur posing as a professional. An insured photographer protects both him/her and you!
